Licensing and Printing Rules for DesignGen

Can I sell designs I make with DesignGen?
Yes, but rights depend on your plan tier and the 48-hour Exclusive Fulfillment Window.
What is the Exclusive Fulfillment Window?
A 48-hour period where DesignGen has exclusive production rights for your design. After this period expires, you may use external manufacturers.
Do I "own" what I create?
You keep your underlying rights, but you grant DesignGen a broad license to use, display, and fulfill orders using your designs.
1. Key Definitions
User Content
Any text, images, prompts, brand assets, or other materials you upload or input into DesignGen. This includes your prompts, reference images, logos, and any other creative inputs you provide.
Generated Output
The designs, images, mockups, and other creative works produced by DesignGen based on your User Content. This is the AI-generated artwork you receive after submitting a prompt or request.
Exclusive Fulfillment Window
A 48-hour period beginning when a Generated Output is first created, during which DesignGen retains the exclusive right to manufacture, print, or otherwise produce physical products featuring that design.
2. Ownership and Licensing
You retain ownership of any original User Content you upload (such as your own photographs, logos, or brand assets). For Generated Output, to the extent permitted by applicable law, you may own intellectual property rights in works you create using the platform.
By using DesignGen, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Use, reproduce, modify, and display your User Content and Generated Output
- Manufacture, fulfill, and ship products featuring your designs
- Feature your public designs in marketing, galleries, and promotional materials
- Train and improve our AI models and services
Unless you are on a plan that offers private designs, your creations may be displayed publicly in galleries, used in marketing, or otherwise shared. Do not upload confidential business information unless you have a plan that includes private design features.
AI-generated designs may inadvertently resemble existing copyrighted works, trademarks, or other protected materials. DesignGen does not guarantee that Generated Output is free from third-party intellectual property claims. You are responsible for conducting your own due diligence before commercial use.
3. Plan Tiers and What You Can Do
4. 48-Hour Exclusive Fulfillment Window
For the first 48 hours after a Generated Output is created, DesignGen has the exclusive right to manufacture, print, or produce physical products featuring that design. During this window:
- You may not use external print shops, manufacturers, or fulfillment services
- You may order products through DesignGen's fulfillment services
- You may list products for sale (with DesignGen fulfillment)
Once the Exclusive Fulfillment Window expires, Creator and higher plan members may use external manufacturers, print-on-demand services, or fulfill orders themselves. Free and Hobbyist plan members should refer to their plan-specific limitations.
Enterprise customers may negotiate a "Release Token" as part of their custom agreement, which allows immediate external manufacturing without waiting for the 48-hour window to expire. Contact our sales team for details.
Sarah creates a design on Monday at 2:00 PM. During the next 48 hours, she can:
- - List the design on her Etsy shop
- - Fulfill orders through DesignGen
- - Download the design files
On Wednesday at 2:00 PM, she can start using her local print shop.
Mike creates a design for a personal gift. He cannot sell it commercially, but he can:
- - Order a single shirt for himself
- - Share the design on social media (with attribution)
- - Use it for non-commercial purposes
To sell designs, Mike would need to upgrade to Hobbyist or Creator.
5. Public vs Private Creations
Free and Hobbyist plans default to public. Designs may appear in galleries, be featured in marketing, or be visible to other users.
Creator and Enterprise plans include private designs. Your work remains confidential and is not displayed publicly.
- Confidential business information (unless on a private-enabled plan)
- Trade secrets or proprietary designs not ready for public release
- Content you do not have rights to use or share
6. Your Responsibilities Before Selling
Trademark Check
Search USPTO, EUIPO, and other relevant trademark databases to ensure your design does not infringe on existing trademarks.
Copyright Check
Verify that your design does not substantially copy existing copyrighted works. AI outputs may inadvertently resemble protected content.
Right of Publicity
If your design includes recognizable faces or likenesses, ensure you have proper releases or the right to use those images commercially.
Proof Your Design
Order a sample to verify print quality, color accuracy, and placement before selling to customers.
Plan Tier Check
Confirm your subscription plan permits commercial use at the scale you intend. Free plans do not include commercial rights.
7. What is Not Allowed
Uploading Content Without Rights
Do not upload images, logos, or other content you do not own or have permission to use.
Infringing or Counterfeit Designs
Creating designs that copy or imitate protected trademarks, copyrighted characters, or other intellectual property.
Illegal or Abusive Content
Content that is illegal, harmful, harassing, defamatory, or violates the rights of others.
Model Extraction or Reverse Engineering
Attempting to extract, reverse engineer, or replicate DesignGen's AI models or underlying technology.
Violating the Exclusive Fulfillment Window
Using external manufacturers or print services during the 48-hour window without authorization.
8. If You Cancel or Lose Access
Not a Storage Service
DesignGen is not intended as a long-term storage solution for your designs. We may delete designs after a period of account inactivity or upon cancellation.
License Revocation on Termination
If your account is terminated for cause (e.g., Terms violation), your commercial license to use Generated Output may be revoked. Designs already sold may be subject to additional terms.
Keep Local Backups
We strongly recommend downloading and maintaining local backups of all designs you wish to keep, especially those used commercially.
9. Licensing FAQ
Yes, if you have a Hobbyist, Creator, or higher plan. Free plans do not permit commercial sales. The sales channel does not matter - what matters is your plan tier and compliance with the Exclusive Fulfillment Window.
Yes, but only after the 48-hour Exclusive Fulfillment Window expires, and only if your plan permits external manufacturing (Creator or higher). During the window, all production must go through DesignGen.
Generally no. Standard plans license you to sell physical products featuring the design, not to resell the digital artwork files. Selling digital files may require a custom Enterprise agreement.
Yes, but you are responsible for ensuring you have proper authorization from the customer to use their logos or brand assets. DesignGen is not liable for unauthorized use of third-party content.
No. AI models are trained on large datasets and may produce outputs that resemble protected works. You are solely responsible for determining whether a design is safe for commercial use and for any infringement claims that may arise.
Yes, on Creator and Enterprise plans. Hobbyist plans may offer private designs for an additional fee. Free plan designs are public by default.
